Privacy Notice for Rendia End-Users

Thank you for your interest in Rendia, Inc. (“Rendia”, “we” or “us”) (we may refer to you as “you” or “Rendia End-User” or “End-User” in this privacy notice), and the end-user application of our product, Rendia (the “Application”). We are committed to protecting your personal privacy. Our success depends on your trust. To better protect your privacy, we provide this privacy policy to inform you of our practices with respect to how we collect and use personal information.

The Information We Collect

The Application collects no personally identifying information from you. Rendia may collect certain non-personally identifiable information upon viewing the Application such as the type of browser, computer, operating system, domain server, IP address and other information relating to the computer system you are using. We may also collect data such as what presentations were viewed, the time and date associated to the viewing and other such patterns of navigation through the Application. The Application does not use “cookies”.

How We Use the Information

Rendia may use the non-personally identifiable information for statistical purposes. We also may use this statistical information in the aggregate to analyze usage of the Application. Furthermore, Rendia may share this aggregate, statistical information with relevant third parties when appropriate. In addition, Rendia may use the non-personally identifiable information that we collect to improve the design, operation and content of the Application and administer our systems.

Rendia will disclose information we maintain when required to do so by law, for example, in response to a court order or a subpoena. We also may disclose such information in response to a law enforcement agency’s request or the request of other governmental authorities or to prevent harm to yourself or others. We may also disclose such information if we believe in good faith that such action is required to protect or defend our rights or property against the misuse or unauthorized use of the Application.

If our information practices change at some point in the future, we will post changes on this page. If you have any concern about how your information is used or disclosed, please check our online privacy policy from time-to-time.

Third Party Advertisements and Links

In connection with the Application, we may provide links to third party advertisements and websites whose information practices may be different than ours. These third parties may use “cookies”. You should consult the other site’s privacy notices since we have no control over information that is submitted to, or collected by, these third parties.

We are committed to protecting personal privacy. Our success depends on your trust. To better protect your privacy, we provide this privacy policy to inform you of our practices with respect to how we collect and use personal information.

The Information We Collect

We collect information from you if you contact us, including identifying and contact information, such as name, address, email address and phone number. We also may collect certain non-personally identifiable information when you become a customer such as the type of browser, computer, operating system, domain server, IP address and other information relating to the computer system you are using. We also collect information relating to the products and services you acquire from us and other information relating to your customer relationship with us, including financial information, user name and password.

We may also utilize “cookies” and other tracking technologies like pixel tags and web beacons (often called “smart cookies”) to improve the functionality of the Site. Cookies are text files that are sent by servers to web browsers and stored on your computer. They tell us which parts of the Site you’ve visited so we can alert you to software compatibility issues and save your preferences for future visits to the Site. Web beacons and pixel tags are images embedded in a webpage or e-mail for the purpose of measuring and analyzing usage and activity. The Site, or third-party service providers acting on our behalf, may use web beacons and pixel tags to help us analyze usage and improve our functionality. Some cookies and other technologies may serve to recall personally identifiable information previously provided by an End User.

We also may use cookies provided by Google Analytics or other third parties to help us measure how visitors use the Electronic Platforms. The information collected is used for a variety of purposes, including, but not limited to, site traffic reporting, unique visitor counts, and content optimization. Although Google Analytics logs the information coming from the Site on our behalf, we control how the data may and may not be used. How We Use the Information

We use the information you provide about yourself to fulfill your requests and respond to your inquiries about our offerings. We sometimes use this information for statistical purposes and to communicate with you or to contact you about your account with us and otherwise manage your account with us. From time to time, we may use the personally identifiable information that we collect to offer you other products or services that we believe may be of interest to you. As a matter of policy, we do not sell or rent any of your personal information to third parties for their marketing purposes without your explicit consent. We use the non-personally identifiable information that we collect to improve the design, operation and content of our Site and administer our systems. We also use this information to enable us to personalize your experience on our Site and in connection with our products and services you use. We also may use this information in the aggregate to analyze usage of our Site, as well as to offer you products or services.

We use information collected from cookies and other technologies to improve your user experience and the overall quality of our services. We use cookies to help us identify and track visitors, their usage of the Site, and their access preferences. We may use your personally identifiable information to see which web pages you visit at our Site, which website you visited before coming to our Site, and where you go after you leave our Site. We can then develop statistics that help us understand how our visitors use the Site and how to improve it. Visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the Site; provided, however, that Rendia disclaims, and you hereby waive, any claim or liability that may arise due to your partial or incomplete access to the content of the Site as a result thereof.

We may provide such third party vendors your personally-identifiable information for their use as necessary to fulfill their contracts with us. From time to time, we may use the personally identifiable information of our customers for new, unanticipated uses not previously described in our privacy notice. If our information practices change at some point in the future, we will post changes on this page. In connection with the Site, we may provide links to third party websites whose information practices may be different than ours. You should consult the other site’s privacy notices since we have no control over information that is submitted to, or collected by, these third parties.

For End-Users and Visitors

Security

We employ procedural and technological measures, consistent with legal requirements and the demands of customer service, reasonably designed to protect your personal information from loss, misuse or unauthorized access, disclosure, alteration or destruction. However, we cannot assure you that personally identifiable information that we collect will never be disclosed in a manner that is inconsistent with these Privacy Policies.

California Residents

California residents are entitled to contact us to request information about whether we have disclosed personal information to third parties for the third parties’ direct marketing purposes. As noted above, however, we do not share personal information with third parties for their own marketing purposes. California customers may request further information about our compliance with this law by e-mailing us at the address listed in the “Questions?” section below.

The above rights are separate from rights that California residents may have under the California Consumer Privacy Act (“CCPA”). Note that we are not subject to the CCPA as a “business” (as defined in the statute). Nonetheless, we respect the privacy and wishes of individuals regarding their privacy. As such, you may make a request regarding our use, handling and protection of your personally identifiable information by contacting us as described in the “Questions?” section below. 

International Visitors and End-Users

If you are visiting Site from, or using the App in, the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring information about you, including personally identifiable information, to a country and jurisdiction that may not have the same data protection laws as your country of residence, and you consent to the transfer of information about you, including your personally identifiable information, to the U.S. and the use and disclosure of information about you, including your personally identifiable information, as described in this Privacy Policy.

Information Regarding Commercial Electronic Messages (“CEM”) in Canada

Canada’s Anti-Spam Law requires that we obtain the express consent of Canadian citizens before sending an electronic message such as an email that contains a promotion about our products. We will ask you for your explicit consent when you provide us with your email address or other personal information through which we intend to encourage your participation in a commercial activity, such as a promotion for our products.

If you explicitly consent to receiving CEM, each communication sent to you will contain an option to unsubscribe to the communications or to revoke your consent to receive CEM. Alternatively, you can contact us at the address or email provided below in the “Contact Us” section to be removed from our mailing lists.

Visitors and End Users from Switzerland, United Kingdom and the European Economic Area

This section describes our privacy practices with respect to personal information that is subject to the European Union’s General Data Protection Regulation and the UK Data Protection Act of 2018 (collectively, the “GDPR”)  In the event that we collect Personal Data (as defined in the GDPR) that is subject to the GDPR, this section will also apply, but only to such Personal Data. Terms in this section are to be understood in a manner consistent with GDPR including the definition of such term in the GDPR. Such term may have a different definition or meaning in other portions of this Privacy Policy.

Legal Basis for Processing: 

GDPR allows processing of personal data based on one of six legal bases.  The legal bases for processing personal data are:

  1. Consent – your freely given, specific, informed and unambiguous indication of your wishes by which you agree to the processing of personal data.
  2. Contract – Rendia needs to process your personal data for performance of a contract or processes the information at your request prior to entering into a contract.
  3. Legal Obligation – processing is necessary to comply with a legal obligation.
  4. Vital Interests – your (or someone else’s) health, safety or other vital interests require processing personal data.
  5. Public Interest – Rendia needs to process personal data to carry out a task that’s in the public interest.
  6. Legitimate Interest – processing personal data is in our legitimate interests.

Onward Transfer:

We will not disclose Personal Data to a third party except as stated below:

We may disclose Personal Data to subcontractors and third-party agents. Before disclosing Personal Data to a subcontractor or third-party agent, we will obtain assurances by contractual agreement from the recipient that it will: (i) transfer such data only for limited and specified purposes; (ii) ascertain that the subcontractor or third-party agent is obligated to provide at least the same level of privacy protection as is required by the GDPR; (iii) take reasonable and appropriate steps to ensure that subcontractors and third-party agents effectively process the personal information transferred in a manner consistent with the organization’s obligations under the GDPR; (iv) require subcontractors and third-party agents to notify the organization if it makes a determination that it can no longer meet its obligation to provide the same level of protection as is required by the GDPR; (v) upon notice, including under (iv), take reasonable and appropriate steps to stop and remediate unauthorized processing; and (vi) provide a summary or a representative copy of the relevant privacy provisions of its contract with subcontractors and third-party agents to the Supervisory Authorities upon request.

We may also be required to disclose, and may disclose, Personal Data in response to lawful requests by public authorities, including for the purpose of meeting national security or law enforcement requirements, or in the event of a merger or acquisition. 

Retention of Personal Data: 

Personal Data subject to GDPR and obtained by Rendia is adequate, relevant and not excessive in relation to the purposes described in this Privacy Policy. The Personal Data is processed for purposes specified herein and will only be processed consist with these purposes described herein. We will request only the minimum amount of information required to perform the applicable services and will retain such information only for as long as necessary to provide the services or for compatible purposes, such as to provide additional services, to comply with legal requirements, or to preserve or defend our legal rights.

Right of Access to your Personal Data

Data Subjects have the right to access the Personal Data an organization holds about them. If such Personal Data is inaccurate or processed in violation of the GDPR, a Data Subject may also request that Personal Data be corrected, amended, or deleted. When we receive Personal Data, we do so on behalf of the individual submitting such Personal Data.  To request access to, or correction, amendment or deletion of Personal Data, Data Subjects should contact us at the address in the “Questions?” section below.  We will cooperate with all reasonable requests to assist Data Subjects to exercise their rights under the GDPR. 

Choice

Data Subjects have the right to opt out of (a) disclosures of their Personal Data to third parties not identified at the time of collection or subsequently authorized, and (b) uses of Personal Data for purposes materially different from those disclosed at the time of collection or subsequently authorized.  Data Subjects who wish to limit the use or disclosure of their Personal Data should submit that request to us. We will cooperate with Data Subjects’ instructions regarding the above Data Subject choices.

Transfers to the United States from the European Union:  

When we transfer personal information from the EU to entities within our organization located outside of the EU, we may rely on standard contractual clauses adopted by the European Commission to help establish adequate safeguards. If we transfer personal information from the EU to another party located outside the EU, we may rely on a legal framework that provides appropriate safeguards, which could include the standard contractual clauses, binding corporate rules, or another framework deemed adequate by the European Commission.

Do Not Track

Some browsers have a “Do Not Track” feature that lets you tell websites and online services that you do not want to have your online activities tracked. Such browser features and industry standards are not uniform, so our websites and online services do not respond to those signals.

Terms of Use

Our Privacy Policies are incorporated into and subject to our Terms of Use including, without limitation, the governing law, disclaimers, liability limitations and dispute resolution provisions.

Policy Changes

We reserve the right to change this privacy policy and will post any revisions on our Site. Your continued use of our Site will be subject to the then-current privacy policy.
